Terms of Use

The My Honda portal ("Portal”) is owned and operated by Honda Australia Pty Ltd ACN 004 759 611 (“we”, “us” or “our”). These Terms of Use govern your access to, and use of, the Portal. By creating an account and using the Portal, you are agreeing to be bound by these Terms of Use.

1. Changes to Terms of Use

We may change these Terms of Use at any time and without notice. We will publish any revised Terms of Use to the Honda website, which will apply and take effect from publication. Your continued access to, and use of, the Portal will mean you agree to the revised Terms of Use. You should regularly check this page to ensure you are familiar with the most current version of the Terms of Use.

2. Customer account

You must create a My Honda account to access the Portal. Each vehicle owner may only create one My Honda account on the Portal. We may delete any duplicate accounts from time to time, without notice.

You must keep your login details, including your password, secure. You are responsible for all activity conducted using your My Honda account.

3. Use of Portal

You may only use the Portal for personal use and for the purposes of managing your Honda vehicle ownership and utilising the features we deliberately make available through the Portal from time to time, such as:

(a) updating your contact details;

(b) adding and removing new drivers and contact persons;

(c) booking your vehicle service;

(d) arranging a safety recall involving your vehicle;

(e) notifying us of a change of vehicle ownership; and

(f) viewing and receiving information and communications from us.

4. Your responsibilities

You must:

(a) keep your My Honda account up-to-date, including contact and vehicle details;

(b) keep your My Honda account secure and not allow any other person to use the account;

(c) not do anything that compromises the Portal, or disrupts or interferes with the performance or functionality of the Portal;

(d) not attempt to gain unauthorised access to any part of the Portal; and

(e) not use the Portal in any way that is unlawful or harms us.

5. Your content

We have access to all content you upload or provide on or via the Portal (“Content”). You must ensure that your Content does not:

(a) contain any defamatory, libellous, harassing, offensive or unlawful material;

(b) contain any viruses, bugs or other malicious code;

(c) infringe our rights or third party rights; or

(d) breach any law.

You agree to grant us a non-exclusive, irrevocable, perpetual, royalty-free right to use your Content in any way we require.

6. Intellectual property

We own all trade marks, copyright and other intellectual property rights in the Portal, unless indicated otherwise. This includes branding, text, images, graphics, and their arrangement on the Portal. Misuse of our intellectual property is strictly prohibited.

You may not modify, copy, re-publish, frame, distribute or communicate any part of the Portal (including the information contained within it) or use it in a way that infringes the intellectual property or other rights of Honda or our service providers.

7. Privacy

The personal information you provide on or via the Portal will be collected, used, disclosed and otherwise managed in accordance with our Privacy Policy.

If you provide the personal information of another person on or via the Portal, we rely on you to obtain that person’s consent and notify them that:

(a) we collected their personal information to manage matters relating to your vehicle ownership;

(b) we may disclose their personal information to Honda Centres and service providers who assist in the operation of our business;

(c) our privacy collection statement is available at www.honda.com.au/privacy-collection and contains more information about our collection of their personal information; and

(d) our privacy policy is available at www.honda.com.au/privacy and contains information about how they can access and correct their personal information, how they can complain about a breach of the Australian Privacy Principles and how we deal with the complaint.

8. Disclaimer

We may change the Portal at any time and without notice, including changing, removing and replacing features of the Portal.

The Portal is provided “as is”, without warranty of any kind (including as to the availability of the Portal or the reliability or accuracy of the information on the Portal), to the extent permitted by law. Your access and use of the Portal is at your own risk.

Information on the Portal is:

(a) for general information only and does not purport to be comprehensive, accurate or suitable for your purposes; and

(b) current only at the time it is published.

We are under no obligation to update the information on the Portal or correct any inaccuracy that becomes apparent at a later time. To the extent permitted by law, Honda specifically excludes any liability for an error or inaccuracy in, or omission from, the Portal and any loss or damage that you or any other person suffers by relying on any information on the Portal, whether caused by our negligence or otherwise.

We also cannot guarantee the security of information transmitted to us via the Internet, although we use our best endeavours to do so. Honda will not be liable in any way in relation to any breach of security during Internet transmissions of personal information, including any unintended loss, misuse or disclosure of that information.

9. Liability

You agree that, to the extent permitted by law:

(a) all warranties, representations and guarantees, whether express or implied, arising by law or otherwise are excluded; and

(b) we are not liable for any direct, indirect, incidental, consequential, special or exemplary damages, or other losses, costs, or expenses or any kind (including legal fees, expert fees, or other disbursements) which may arise, directly or indirectly, through your access to, or use of, the Portal (or lack of access) or the information contained within it, including your inability to carry out one of the functions provided by the Portal, loss of information or data, or loss caused by any viruses, bugs, human action or inaction on any computer system, hardware, software or program malfunctions, or any other failures or delays in computer transmissions or network connections

You agree to indemnify us against all claims, losses, damages, liabilities and expenses (including legal fees on a full indemnity basis) we incur that arises from, or in connection with, your breach of these Terms of Use or your use of the Portal.

10. Termination or suspension

We may terminate or suspend your access to the Portal at any time and for any reason, without notice, including where you have breached these Terms of Use or we reasonably suspect you have breached these Terms of Use.

You may terminate your access to the Portal at any time by deleting your My Honda account through the Portal or calling us.

11. Applicable law

These Terms of Use are governed by the laws of Victoria, Australia and any disputes regarding these Terms of Use will be decided by the courts in Victoria, Australia.
