Terms and Conditions

PROMOTION TERMS  

1. The Promoter is Honda Australia Pty Ltd ABN 66 004 759 611, Level 4/6 Gladstone St, Moonee Ponds VIC 3039 (Promoter).
   
   
2. The name of the Promotion is Service for a chance to win AUD$40,000 of Honda products (Promotion).

   Eligibility
   
   

3. To be eligible to enter the Promotion, you must:
   1. be an Australian resident;
   2. hold a current Australian full or probationary driving licence;
   3. be aged 18 years or over;
   4. own a Honda car that is due for a standard scheduled service during or before the Promotion Period, and has not yet undergone that service; and
   5. comply with these terms and conditions,

      (Eligible Entrant).
      
      

4. Directors, management, officers and employees (and their immediate families) of the Promoter are not eligible to enter the Promotion.
   
   
5. Promotion Period: From 12am (AEST) on 15 July 2024 to 11:59pm (AEST) on 30 September 2024.

   Entries
   
   

6. To enter, you must do the following during the Promotion Period:
   1. complete a standard scheduled service of your Honda car with an Authorised Honda Centre (Qualifying Service); and
   2. complete and submit the Promotion entry form accessible by clicking on the link contained in the email or text message from the Promoter addressed to you containing an offer to participate in the Promotion or scanning the QR code link available at an Authorised Honda Centre.
      
      
7. To avoid doubt, services or repairs performed at an Authorised Honda Centre that are not standard scheduled services, and any services performed at unauthorised centres, are not Qualifying Services.
   
   
8. Your entry will be deemed to be received at the time the completed entry form is received by the Promoter.  Entries received outside of the Promotion Period will only be included in the Promotion at the Promoter’s sole discretion.
   
   
9. Each Eligible Entrant may submit one entry during the Promotion Period, regardless of the number of Qualifying Services completed. Any additional entries will be excluded.
   
   
10. The Promoter reserves the right to disqualify you if the Promoter becomes aware that you or your entry does not comply with these Terms and Conditions.  You are required to retain your invoice or receipt in relation to the Qualifying Service.
    
    
11. Entry into the Promotion shall be deemed an acknowledgement and acceptance of these terms and conditions.

    
    Prize
    
    

12. There will be 1 winner of this Promotion (Winner)
    
    
13. The total prize pool value is AUD$40,000. The Winner will be able to select any of the current Honda motor vehicle, motorcycle, marine, power equipment, and Honda genuine products located at www.honda.com.au, and any HART training or licensing course, (together, Honda Products) up-to the value of AUD$40,000 (inclusive of GST and any fees) (Prize). This means the Prize can also be used to pay for any delivery or other fees associated with the selected Honda Products. However, the Winner must pay any amount above AUD$40,000 if the products and fees collectively exceed AUD$40,000.
    
    
14. The Winner acknowledges and agrees that some Honda Products have longer delivery timeframes or wait times depending on availability.
    
    
15. The Winner agrees to sign any contracts of sale or other documents necessary to receive the Honda Products.
    
    
16. The Winner may not return, seek a refund for, or change their mind about, the Honda Products, except as expressly permitted by law. For the avoidance of doubt, this means the Winner may not terminate a sales contract for any Honda Products selected due to a change of mind, even if the sales contract gives the Winner the right to do so.
    

    Draw
    
    

17. An electronic random prize draw will occur on 14 October 2024 at 12pm (AEDT) to determine the Winner.  The draw will take place at Trade Promotions and Lotteries Pty Ltd (TPAL), currently located at 24/88 Pitt Street, Sydney, NSW 2000.
    
    
18. The Promoter may draw additional entries and record the entrant for each, in the order they were drawn, to be considered in case the Winner is later deemed to not be an Eligible Entrant (Reserve Winner).
    
    
19. If you are a Winner, you will be notified by phone and email on or before 18 October 2024.
    
    
20. You must claim the Prize by 5pm (AEDT) on 25 October 2024 by responding to the Promoter’s email to acknowledge you will accept the prize and provide all requested information (Claim Period).
    
    
21. Where required by a relevant statutory authority in the Winner’s Australian jurisdiction, the Promoter will publish the name, or initials, or postcode, or any combination of these things of the Winner on the Promoter’s website https://www.honda.com.au/owners/servicing on 25 October 2024.
    
    
22. You must then email the Promotor by 5PM (AEDT) on 8 November 2024 to inform the Promoter of the Honda Products you have selected to redeem the Prize on. Any remaining amount of the Prize that is not redeemed will be forfeited.
    
    
23. If you do not claim the Prize for any reason during the Claim Period, despite every reasonable effort taken by the Promoter to contact you, the Promoter will conduct another electronic draw (Redraw) to determine the Winner.  Once the Claim Period ends, you will no longer be deemed the Winner.

24. The Redraw will be an electronic random prize draw on 1 November 2024 at 12pm (AEDT).  The draw will take place at TPAL.
    
    
25. The Promoter may draw Reserve Winners in case the new Winner is later deemed to not be an Eligible Entrant.
    
    
26. The Winner will be notified by phone and email on or before 7 November 2024.
    
    
27. Where required by a relevant statutory authority in the Winner’s Australian jurisdiction, the Promoter will publish the name, or initials, or postcode, or any combination of these things of the Winner on the Promoter’s website https://www.honda.com.au/owners/servicing on 14 November 2024.
    
    
28. You must claim the Prize by 5pm (AEDT) on 14 November 2024 by responding to the Promoter’s email to acknowledge you will accept the prize and provide all requested information (Redraw Claim Period).
    
    
29. You must then email the Promotor by 5PM (AEDT) on 28 November 2024 to inform the Promoter of the Honda Products you have selected to redeem the Prize on. Any remaining amount of the Prize that is not redeemed will be forfeited.
    
    
30. If you do not claim the Prize for any reason during the Redraw Claim Period, despite every reasonable effort taken by the Promoter to contact you, the Prize will be forfeited and not awarded to anyone.
    

    General Conditions

31. You are required to take full responsibility for the entry content and for ensuring that the entry content complies with these terms and conditions. “Entry content” includes any content that you submit, upload, transmit, publish, communicate or use in connection with your entry into the Promotion.
    
    
32. The use of automatic entry software, mechanical or electronic devices that allows an entrant to automatically enter the Promotion is prohibited and may render all entries submitted by that entrant invalid.
    
    
33. Incomplete, indecipherable, incomprehensible or inappropriate entries will be deemed invalid. The Promoter takes no responsibility for late, lost, incomplete, indecipherable or incorrectly submitted, misdirected or invalid entries, delays or failures in any equipment or telecommunications service used to administer this Promotion.
    
    
34. The Promoter may, in its absolute discretion, declare an entry invalid or disqualify you or anyone who tampers with the entry process or benefits from such tampering, submits an entry that is incomplete, inappropriate or not in accordance with these terms and conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of this Promotion.
    
    
35. The Promoter reserves the right to require you to verify the validity of your entry within a time specified by the Promoter, including but not limited to your identity, eligibility, age, address and to disqualify you if you do not satisfy any entry criteria in these terms and conditions. If there is a dispute as to your identity, the Promoter reserves the right, in its sole discretion, to determine your identity. Errors and omissions may be accepted at the Promoter’s sole discretion. Proof considered suitable for verification is at the Promoter’s discretion.
    
    
36. If you are a Winner but do not claim the Prize (or otherwise forfeit the Prize), the Promoter may still use your entry in accordance with these terms and conditions. 
    
    
37. The Prize or any element of the Prize must be taken in whole and is not transferable, exchangeable or redeemable for cash. Prize values are in Australian dollars.
    

38. You will not be charged an administrative or delivery fee for the Prize.  However, any additional costs applicable to the collection and use of the Prize that are not expressly stated in these terms and conditions will be your sole responsibility.  Information on how to enter, the Prize, and other details contained within promotional material form part of these terms and conditions. These terms shall prevail to the extent of any inconsistency with any promotional material.
    
    
39. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
    
    
40. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of administering this Promotion (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a Prize.
    
    
41. All of the Promoter's decisions in relation to all aspects of this Promotion are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    
    
42. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), as well as any other applicable implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
    
    
43. The Promoter, its associated companies and agencies and any of their personnel exclude all liability, except for any liability that cannot be excluded including the Non-Excludable Guarantees, for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by the Winner in connection with the Promotion, or the Prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a related entity or agent of the Promoter; and (iii) any liability for personal injury or death.
    
    
44. The Promoter assumes no responsibility for any tax consequences related to the collection or use of the Prize.  It is your responsibility to seek independent financial advice in relation to the Prize. 
    
    
45. If this Promotion is interfered within any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    
    
46. This Promotion is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. and entrants expressly release Meta Platforms, Inc. for any loss or damage suffered as a result of participating in the Promotion.
    
    
47. The Promoter’s decision is final and no correspondence will be entered into.
    
    
48. The Promoter may acquire your personal information directly or through its agents and contractors, for the purposes of conducting the Promotion, promoting its goods or services and/or marketing purposes. 
    

49. As a condition of entry, you consent to the Promoter using your name, likeness, image, voice and/or entry in promotional and advertising activity at any time, without compensation. By participating in the Promotion, you consent to these uses and disclosures of your personal information.  If you are the Winner you must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) related to winning the Prize, free of charge.
    
    
50. Your personal information may be disclosed by the Promoter to its related companies, contractors, agents and to State and Territory lottery departments to assist in conducting the Promotion, storing data, communicating with you or as required by law.  Some of these third parties may be located overseas.
    
    
51. If you do not provide the personal information the Promoter requests, the Promoter may not be able to provide entry into the Promotion. All personal information is handled in accordance with the Promoter’s Privacy Policy (https://www.honda.com.au/privacy), these terms and conditions and the following Privacy Collection Notices:

You expressly consent to the Promotor providing your personal information to its related entities for the purpose of promoting the Promotion and the Honda Products.

52. The Promoter’s privacy policy contains information about how you can access or correct your personal information, or make a complaint about a breach of the Australian Privacy Principles.

53. Entry into the Promotion also entitles the Promoter and any related companies that use the Promoter’s name (“we”/”us”) to let you know from time to time about news, offers, products and services you might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, your personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Promoter’s Group, or our service providers already hold about you. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. It is a condition of entry that you consent to receive the Promoters’ marketing communications, although you may opt out of, or unsubscribe from, receiving marketing communications at any time, under applicable legislation.
